Samenvatting This report discusses the experiences and views of people who may have been discriminated against on the basis of their sexual orientation or sex and/or gender identity, of a consultation, conducted by the Australian Human Rights Commission. It aims to inform and assist the implementation of the national Human Rights Framework, announced in April 2010. During the consultation, the Commission heard many personal stories of discrimination, violence, harassment and bullying on the basis of sexual orientation and sex and/or gender identity. The majority of consultation participants identified a need for greater protection from such discrimination, supporting the inclusion of protection from discrimination on these grounds in federal anti-discrimination law. This report aims to capture the diverse range of views expressed by participants in the consultation about measures that would improve human rights protections for people of all sexual orientations and sex and/or gender identities.

Samenvatting The ICJ (International Commission of Jurists) is writing to express its concern at a proposed amendment to the Administrative Code that, if enacted, would undermine Lithuania's obligations under international human rights law. According to the information we have received, the proposed amendment No. XIP-2595 would add a new provision, Article 214(30), entitled "Public promotion of homosexual relations." Under this provision, "public promotion of homosexual relations is to be punished by a fine from two thousand to ten thousand litas." The ICJ believes that this amendment, if enacted, would threaten the rights to freedom of expression and freedom from discrimination, which are guaranteed under both the European Convention on Human Rights and Fundamental Freedoms and the International Covenant on Civil and Political Rights.

Samenvatting Discrimination and violence against lesbians, gays, bisexuals, and transgender (LGBT) persons in Iran is widespread in its scope and horrific in its consequences. This report does not undertake a comprehensive analysis of this culture of violence and discrimination. It is rather restricted to raising concerns about the most serious human violations faced by LGBT persons in Iran. As such, it examine three internationally recognized human rights which are of great relevance to sexual minorities: the right to life, the right not to be tortured or subjected to inhumane or degrading treatment, and the right to freedom of expression; and it examines the manner in which the Iranian government violates them with respect to sexual minorities.

Samenvatting The Inter-ministerial programme that is described in this document has been established according to what is set out in the statute of autonomy and in the government plan, and is the manifestation of the government's commitment towards the gay, lesbian and transsexual community. The government's objective is to do away with any kind of legal discrimination towards homosexual and transsexual people; but what's more, this legal equality must also bring about the end of the social discrimination that gays, lesbians and transsexual women and men have historically suffered in Catalonia. Via the programme described herein, the government will work so that lesbians, gays and transsexuals can live completely normal lives with full social visibility: in all walks of life, in any city or town in Catalonia. To reach this goal, this document details a series of government actions to be taken in different areas, dealing with homosexuality and transsexuality from a global perspective, affecting all aspects of ordinary life. Specifically, the Inter-ministerial programme works on the fields of: legislation and law, employment, healthcare, education and training, culture and leisure, communication, welfare, and participation and solidarity.

Samenvatting Between 1999 and 2007, three important demands of the LGB (lesbian, gay, and bisexual) movement in Belgium were realised: the anti-discrimination law, the opening up of civil marriage to same-sex partners, and the opening up of adoption to same-sex couples. As a result, Belgium became one of the world front-runners in the extension of legal rights to LGBs. This article sketches the legal and social position of Belgian LGBs before the federal elections of 13 June 1999 and goes on to provide a detailed, step-by-step historical survey of how the subsequent revolution with respect to LGB rights came about. The survey starts with the hesitant introduction of a minimalist partnership regulation, followed by a relatively encompassing anti-discrimination law, and concludes with the obstacle-ridden process of opening up civil marriage first and adoption next. Finally, we discuss the measurable emancipatory effects of recently adopted legislation as well as the various factors that collectively explain the velvet legal revolution in Belgium.

Samenvatting Dieser Ausgabe ist der zweiter Studie zur deutschen Förderung von LSBTI im Globalen Süden und Osten. Dieser Berichte macht deutsches staatliches wie zivilgesellschaftliches Förderengagement für LSBTI sichtbar. Sie zeigt, dass in einigen Bereichen bereits an der Inklusion von Lesben, Schwulen, Bisexuellen, Trans* und Inter*-Personen gearbeitet wird. Gleichzeitig weist die Studie aber auch auf Leerstellen wie die mangelnde Inklusion von Inter* oder auf Barrieren, beispielsweise die Anforderungen bei der Förderung privater Träger, hin. Und sie regt zu Fragen an, wie die nach der tatsächlichen Umsetzung und menschenrechtlichen AusgestaltungAusgestaltung der Förderung, den Förderstrategien und deren Wirkungen wie auch nach der Nachhaltigkeit der Ansätze. Die Studie bietet darüber hinaus Anregungen für Vernetzung und Weiterentwicklung bestehender Förderansätze. Diese Vorschläge kommen zu einem Zeitpunkt, an dem sich das Bundesministerium für wirtschaftliche Zusammenarbeit und Entwicklung in seinem im Mai 2011 erschienenen Menschenrechtskonzept zur gezielten Unterstützung von LSBTI verpflichtet hat. It adds that LGBT persons, such as Dato Gabunia, has to move abroad to practice his sexual preference and to avoid discrimination.

Samenvatting In 2009 the International Commission of Jurists began to gather together national court decisions that addressed questions concerning sexual orientation and gender identity. It did so because it had become evident that battles over some of the most controversial issues of the day were being waged in domestic courts. A very small number of cases can be brought before international human rights bodies - such as the regional human rights commissions and courts and UN treaty bodies - but increasingly international human rights arguments were being heard at the domestic level. What you have before you is the result of this research. The fourteen chapters are organised by topic. Each chapter begins with a general introduction to that particular field of law, followed by case summaries. The latter set forth the legal issue and the relevant domestic, comparative and international law, and then summarise the arguments, reasoning, and result. Cases that are summarised in the Casebook are bold-faced throughout the text. Altogether, the Casebook consists of 108 cases, from 41 countries across a variety of regions, covering a span of more than forty years. The vast majority of decisions, nevertheless, date from the past decade. The pace of change is clearly accelerating. The Casebook has two purposes. First, it should help lawyers, judges, and human rights activists better understand how to use the law to protect individual rights. Second, the ICJ hopes that the Casebook will stand as evidence for the claim that law on sexual orientation and gender identity is global in nature.
